From 12 September 2025, the EU Data Act (Regulation (EU) 2023/2854) introduces new legal obligations for merchants selling connected products on marketplaces.

If you sell connected products, you must provide your customers with clear pre-contractual information about the data your products generate and how customers can access and use it.

What information must be provided?

Under Article 3(2) of the EU Data Act, sellers of connected products must inform customers about:

  • The type, format, and amount of data generated (e.g., usage data, sensor data, file type).
  • Whether the data is generated in real-time or continuously.
  • Where the data is stored (on the device or remote server) and for how long.
  • How the customer can access, retrieve, or delete this data.
  • Any additional details required under the regulation.

This information must be available to the customer before purchase.

What you have to do

To comply, new attributes have been added where you can enter the required information or provide a stable manufacturer link that points directly to it.

Attributes to complete:

  • PROD_FEAT_94000 – Form, type, and volume of data generated
  • PROD_FEAT_94001 – Real-time data generation
  • PROD_FEAT_94002 – Capability of storing data
  • PROD_FEAT_94003 – Duration of data retention
  • PROD_FEAT_94004 – Data accessibility for user
  • PROD_FEAT_94005 – Additional information (EU Data Act)
  • PROD_FEAT_94006 – Link to manufacturer information

We would like to use this email to draw your attention to an important new legal obligation when selling “connected products”.

The EU Data Act (Regulation (EU) 2023/2854 < https://mein.mms-marketplace.com/e/975023/-EN-TXT--uri-CELEX3A32023R2854/5jqyx/498187920/h/06gcKsfHSIcHxiqgQo6vVs5FwzNR32hcxWqEsGFd_1M > ) will apply from 12 September 2025. If you are a seller of connected products, you must provide your customers with certain pre-contractual information. Customers must be informed about the type, duration, and scope of the data generated and their right to transfer data to third parties. They must also be instructed on how to access the data.

What is a “connected product”?

According to the legal definition, a connected product is “an object that obtains, generates, or collects data about its use or environment and that can transmit product data via an electronic communications service, a physical connection, or device-internal access, and whose main function is not the storage, processing, or transmission of data on behalf of another party—except the user.”

Practical examples of connected products: In a broad sense, this refers to all IoT (Internet of Things) products. These can include smartwatches and fitness trackers, as well as smart home devices (smart thermostats, robot vacuum cleaners, etc.) and numerous other products. Please check for yourself whether your products are included. If you are unable to make an assessment yourself, we recommend that you contact the manufacturer or visit their website for more information. What information do you need to provide?

The information requirements are specified in Article 3(2) of the EU Data Act. These include:

• Type, format, and estimated scope of the product data (e.g., what data is generated (usage data, sensor data), in what file format it is available (CSV, JSON, proprietary), and how much data is expected to be generated).

• Whether data is generated continuously/in real time.

• Whether data is stored on the device or on a remote server (including storage duration).

• How users can access/retrieve/delete the data (technical means, terms of use, service quality).

How can you implement this on the MMS Marketplace?

We have introduced new tabs for attributes where you can enter the above information directly. If manufacturers provide the required information on their website, you can also insert a stable link that leads specifically to this information. Please ensure that the information is clear and complete. We would like to point out that this is a legal obligation that you as the seller must fulfill yourself.

What do you need to do now?

1. Please check whether your offers are connected products as defined.

2. Enter the required information in the new PROD_FEAT (see below) or insert a reliable manufacturer link (in consultation with your supplier or the manufacturer, if necessary).
